This privacy policy governs your use of the software application BE SMART, created by Downing Development, LLC. The app is a to-do list that was designed to help promote a healthy lifestyle.

BE SMART only reads data based on the tasks that are included in the app. BE SMART does not transmit any data read from the  app across the Internet to any server.

BE SMART may record anonymous non-identifiable data automatically related to usage patterns within the app. This data may include, but is not limited to, the type of mobile device you use, your mobile operating system and your progress within the app. Only aggregated, anonymous data is transmitted securely to an external analytics service. This data is not disclosed to any other third parties, except in the following cases:

• as required by law, such as to comply with a subpoena, or similar legal process;

• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. 

You may opt-out of anonymous analytics collection by BE SMART by uninstalling the app using the standard iOS app uninstall process.

This Privacy Policy may be updated from time to time for any reason. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
